The short version. Use List Rails to clean your own lists, as much as you like. Don't resell it, don't rebuild it from our code, and don't run it as a service for other people. Your files stay in your browser, so we can't lose them — but we also can't recover them. What you do with the list you export is on you, including every rule your MLS and the do-not-call laws put on it.
These terms are a contract between you and List Rails. They cover the website at listrails.com and the application at app.listrails.com (together, the Service). By using either, you agree to them. If you are agreeing on behalf of a brokerage or team, you are confirming you have authority to bind that organisation.
1. What the Service is
List Rails is a browser tool that takes a spreadsheet you already have — an MLS export, a tax-record pull, a farm list — and narrows it down: dropping columns you don't need, filtering rows, removing duplicates, and cross-referencing statuses against each other. It then gives you a file back.
All of that happens inside your browser. Your spreadsheet is never uploaded to us, because there is no server for it to reach. This is a deliberate design choice and the reason the privacy policy can make the promises it does. It also means the consequences described in section 6 are real ones, not boilerplate.
2. Beta
List Rails is currently in an open beta and is provided free of charge. During the beta:
- Features may change, move, or be removed without notice.
- The Service may be unavailable at times, and we do not commit to any level of uptime.
- We may introduce paid plans and usage limits. If we do, we will give existing beta users notice by email before anything they rely on stops working for free.
3. What you may do
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own real-estate business, and to use the files it produces however your own data licences allow. That includes using it for clients you represent.
4. What you may not do
- Resell or sublicence the Service, or run it as a bureau or done-for-you service where you process other people's lists for a fee. Cleaning a list for a client you represent is fine; charging people for access to List Rails is not.
- Copy, adapt, or redistribute the application's code. The Service runs in your browser, which necessarily means the code is delivered to your device. Being able to read it is not permission to reuse it, host it, or build a competing product from it.
- Remove or obscure our name, notices, or branding from anything you redistribute.
- Attack, overload, or interfere with the Service, or attempt to gain access to systems or accounts that are not yours.
- Use the Service unlawfully, including in breach of your MLS rules or any law covering contact, marketing, or personal data.
5. Your data, and your responsibility for it
You keep every right you have in the files you put into List Rails, and in the files it gives you back. We claim nothing in them, and — as section 1 explains — we never receive them.
What we do need you to understand is that we cannot tell whether you are allowed to have that data, and we do not check. That responsibility stays with you. In particular you are responsible for:
- Your MLS participation agreement. Data you export from an MLS is licensed to you under rules set by that MLS — covering what you may extract, who may see it, how it may be used for prospecting, and how long you may keep it. Those rules apply to a file you have cleaned exactly as they applied to the original export.
- Do-not-call and contact rules. The Service can produce a list of phone numbers. It does not scrub against the National Do Not Call Registry, any state registry, your own internal do-not-call list, or wireless-number rules. Before you dial or text a list, scrubbing it is your obligation, and the penalties for getting it wrong fall on you.
- Email and messaging law, including consent and unsubscribe requirements, for anything you send.
- Onward transfers. If you send a list to a CRM, a skip-trace vendor, a mail house, or a dialler, that transfer is yours — arranged by you, under your agreement with them. We are not a party to it.
The tool shows you a reminder about do-not-call scrubbing before you export a list with phone numbers. That reminder is a courtesy, not a compliance service, and it is not a substitute for advice from someone who knows your jurisdiction.
6. No backups, no recovery
Because the Service holds nothing, there is nothing for us to restore. If you close the tab before exporting, clear your browser storage, or lose the device, the work is gone and we cannot get it back. Keep your original export until you have the file you want.
The Service stores a small amount of information in your own browser — your theme choice, saved column profiles, and a record of which lists you have already exported, so a later pull can be scrubbed against them. This never leaves your device and is not visible to us. Clearing your browser data clears it.
7. Accuracy
List Rails does what you tell it to. If you set a filter that removes rows you wanted, or map a column to the wrong field, it will do that faithfully. Check the preview before you export, and check the exported file before you act on it. We do not warrant that the output is complete, correct, or fit for any particular campaign.
8. Our intellectual property
The Service — its code, design, interface, presets, wording, and the List Rails name and logo — belongs to us and is protected by copyright and trademark law. These terms give you permission to use the Service. They do not transfer any ownership.
If you send us feedback, ideas, or bug reports, we may use them to improve the Service without owing you anything for them. You are not giving up anything you already own by telling us what is broken.
9. Fees, if and when they start
Paid plans are not yet live. When they are, the price, billing period, and cancellation terms will be shown before you are asked to pay, subscriptions will renew automatically until cancelled, and you will be able to cancel at any time with effect from the end of the period you have paid for. Fees already paid are not refundable except where the law requires it. We will publish updated terms covering payment before charging anyone.
10. Third parties
The Service links to and can produce files for other companies' products — CRMs, skip-trace vendors, and similar. We do not control them, we are not responsible for them, and your relationship with them is governed by their terms, not ours.
11. Warranties — or the absence of them
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will produce any particular commercial result.
12. Limitation of liability
To the fullest extent the law allows, List Rails will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost business, lost data, or regulatory penalties, arising out of your use of the Service — including fines or claims arising from how you contacted people on a list.
Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve months before the claim, or (b) one hundred US dollars. While the Service is free, this means our liability is limited to one hundred US dollars.
Some jurisdictions do not allow some of these exclusions. Where that is the case, they apply to you only as far as the law permits.
13. You cover us for your use
You agree to indemnify and hold harmless List Rails and anyone working for it against claims, losses, and reasonable legal costs arising from your use of the Service, your data, or your breach of these terms — in particular any claim brought by an MLS, a regulator, or a person you contacted.
14. Ending it
You can stop using the Service at any time; nothing to cancel while it is free. We may suspend or end your access if you breach these terms, or if we discontinue the Service. Sections 5, 8, and 11 through 15 survive the end of these terms.
15. Governing law
These terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Davidson County, Tennessee, and you and we both consent to the jurisdiction of those courts.
16. Changes to these terms
If these terms change we will update the date at the top of this page. If a change materially reduces your rights or adds an obligation, we will announce it by email to anyone on the early-access list before it takes effect. Continuing to use the Service after a change means you accept it.

These terms describe how List Rails actually works today and are written in plain language rather than legal boilerplate. They are not legal advice and have not been reviewed by counsel. Before charging for the Service or rolling it out across a brokerage, have a lawyer review this page alongside your MLS participation agreement.
